Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Santa Barbara Hard Money Lender Service (the "Site"), operated by Lead Skills, LLC ("we," "our," or "us"). By accessing the Site, submitting an inquiry, or otherwise using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

Santa Barbara Hard Money Lender Service is a lead-generation service that connects consumers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, fees, and funding timelines, are the sole responsibility of the participating lender.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer or solicitation to lend, an offer of credit, or an agreement to provide financing. Loan programs described on the Site are informational only and are offered by participating lenders, not by Lead Skills, LLC. All loans are subject to borrower and property qualification by the participating lender, and terms are subject to change without notice. Not all applicants will qualify.

4. Eligibility

By using the Site and submitting an inquiry, you represent and warrant that:

• You are at least 18 years old.
• All information you submit is true, accurate, current, and complete, and you will keep it updated.
• You have the legal capacity to enter into binding agreements and to authorize us to share your information as described in our Privacy Policy.

5. Your Consent to Be Contacted

By checking the consent box and submitting your information, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. Your consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text, by emailing [email protected], or by calling 805-507-3552. A current list of participating lenders is available upon request.

6. Equal Opportunity

Santa Barbara Hard Money Lender Service connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information.
• Submit information about another person without authorization.
• Violate any applicable law, regulation, or third-party right, including intellectual property and privacy rights.
• Disrupt, probe, scrape, or interfere with the Site's operation or security.

8. Intellectual Property

The Site and its content, design, graphics, trademarks, and software are owned by or licensed to Lead Skills, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission.

9. Third-Party Links and Services

The Site may link to third-party websites or services, including those of participating lenders. We do not control and are not responsible for the content, privacy practices, or conduct of any third party. Your interactions with participating lenders and other third parties, including any financing they may offer, are solely between you and that third party.

10. Disclaimers

THE SITE AND ALL CONTENT AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT YOU WILL BE MATCHED WITH A PARTICIPATING LENDER OR OFFERED ANY LOAN.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY CONTACT WITH A PARTICIPATING LENDER, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your submission of information, your violation of these Terms, or your violation of any third-party right.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any legal action arising out of or relating to these Terms or the Site shall be filed only in the state or federal courts located in Santa Barbara County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
